Your husband was German or had a secure right of residence himself. Then he dies, or you separate.

You continue to live in Germany—with your own right of residence, independent of your marriage, which the immigration office always renews. Years go by without any problems. Then you find yourself dependent on social benefits because, for example, your pension isn’t enough. And suddenly, the renewal of your residence permit is at risk due to poverty in old age.

Here’s how you can prevent that from happening before it’s too late.

My name is Simon Sonnenberg, an attorney at the Sonnenberg law firm in Düsseldorf.

Today we’re discussing a situation I often encounter in my counseling practice: Widows or divorced women receive a residence permit independent of their marriage under Section 31 of the Residence Act (AufenthG) following family reunification.
This permit is also renewed as long as their livelihood is secure. However, if their income is no longer sufficient—as is unfortunately often the case in old age—the Foreigners’ Registration Office denies renewal of the residence permit, and alternative grounds for residence must be found.

First, a disclaimer: Of course, the situation between a man and a woman can also be the other way around, or involve a same-sex couple—here I am simply describing—for the sake of clarity—the typical scenario in which the woman came to Germany for family reunification and, in her old age, finds herself living alone and facing residency issues.

First, regarding the legal situation: If a foreign national was married to a German citizen or to a foreign national with an independent right of residence and held a residence permit for family reunification, she is granted an independent right of residence under Section 31(1) of the Residence Act (AufenthG), provided that the marital relationship has existed lawfully in Germany for at least three years—or if the spouse dies during the marriage.

This right of residence is then, as the law states, independent of the original requirements for spousal reunification—in other words, it no longer depends on the continuation of the marriage. For the first year, the residence permit is granted regardless of whether or not the woman has sufficient means of support.

Starting in the second year, however, proof of sufficient means of support is required to extend the residence permit. This is often still possible, for example, through part-time employment. However, when retirement age is reached or health issues arise, the woman is often dependent on social benefits, meaning that continued residence under Section 31 of the Residence Act is no longer possible.

What solutions are available?
1. Preventive solution: Apply for a residence permit or even naturalization while you still have a secure source of income. Of course, you’ll need to work on your German language skills and prepare for the naturalization test or the “Life in Germany” test, but make the most of the time you have while you still can. Our experience shows that women who have been taking care of the household and children at home often lag behind in terms of language skills.
2. Exceptions to the requirement to secure a means of support due to age and health status: There are exceptions, but according to case law, they are strictly limited to a few cases, and very comprehensive expert opinions must be available. Ordinary poverty in old age following a life as a homemaker and mother is not sufficient grounds for this.
3. Declaration of Commitment: Someone guarantees financial support, usually the children. Even if they are financially capable in principle—because they have sufficient income—the children still take on a high financial risk for themselves and their families. It’s a dilemma: one doesn’t want to let one’s mother down, but is also responsible for providing for one’s own family.
4. Safety Net: Humanitarian Residence Permit under Section 25(5) of the Residence Act (AufenthG): If a woman has lived exclusively in Germany for decades, has close relatives here—such as children and grandchildren—as well as pension entitlements, and has nothing left in her country of origin, this is referred to as “de facto roots.”

She may still be able to obtain a right of residence under Article 8 of the European Convention on Human Rights and based on the protection of the family under Article 6 of the Basic Law. Depending on the circumstances of the individual case, this can certainly be successful. It is a safety net for emergencies, not a solution one should rely on from the outset.
What does this mean in practice? If you or a member of your family has an independent right of residence under Section 31 of the Residence Act (AufenthG) and is approaching retirement age or is already receiving supplemental social benefits: Do not wait until the next renewal.

Check early on whether you can still meet the requirements for a settlement permit—in particular, the 60 months of mandatory pension insurance contributions and the B1 language proficiency level. The language exam, in particular, can often still be taken with sufficient advance notice and a little support, even at an older age.
Please feel free to contact us if you’re unsure whether this might apply to you or your family—you’ll find our contact information in the video description.

Please note: This video is not a substitute for individual legal advice, and despite careful research, we do not guarantee the accuracy or completeness of the information.

Until next time, your attorney, Simon Sonnenberg.

Imagine this: You are a single foreign woman in Germany who has run the household and raised your children your entire life on a residence permit granted for family reunification with your husband.
